Please read carefully before agreeing to all terms. PAYMENT (1) The Client agrees to pay Keyplay Productions in full the amount agreed to above for the photography services to be rendered by Keyplay Productions. In consideration for this fee, Keyplay Productions will devote the contracted time to cover the occasion; (2) Keyplay Productions will select the best photographs from the session for the client to choose their favourites. RAW (unedited) images are not available for purchase. (3) Payment of balance is due 5 (five) days before the session, via cash or bank deposit or online transfer. LATE FEE Late arrivals will attract a fee of $1,500 for every 15 mins the client is late. After 45 mins, the session can be cancelled and scheduled for another date if the Photographer's schedule allows. RETAINER At the time of the signing of the Contract, The Client shall pay a non-refundable retainer of 50% of the total to Keyplay Productions for the Services, unless otherwise agreed with client. The retainer will be subtracted from the total payment owed by The Client. CANCELLATION/POSTPONEMENT Client understands that by entering into this agreement, the Photographer is foregoing other jobs. In the event of a cancellation or postponement of the portrait session/agreement by Client, the retainer paid is non-refundable. Retainers are transferable if a date change is necessary. Forty-eight hours (48) notice of postponement or cancellation is appreciated. If it is not possible for a session to take place on a scheduled day due to weather, Photographer and Client will reschedule on an agreed date at the earliest date possible, with no additional charge. DELIVERY OF DIGITAL IMAGES AND/OR TANGIBLE PRODUCTS. Unedited digital images will be shared via online or in-person preview appointment with the client within 2 (two) days of date of service, or a date otherwise agreed between client and Photographer. After selections are made, the final edited images will be delivered via email within 7-10 days. Any prints or print products ordered will be delivered within 7 (seven) days after final edited images are delivered. Galleries are stored on the photographer's website for a maximum of 2 (two) months, after which they are removed and archived. Please download and back up your files. COPYRIGHT AND REPRODUCTIONS The Photographer shall retain copyright ownership of all works created in the course of this Contract, including but not limited to, all images in their original and processed formats. It is understood that any duplication or alteration of original images is strictly prohibited without the written permission of the Photographer. Alterations include, but are not limited to, application of filters, cropping, or modifications of any kind. The Photographer does provide the Client permission to resize photographs for Internet-based usage. CLIENT USAGE The Client shall only use the photographic prints, including digital files, in accordance with the permissions within this Contract. The Client’s prints are for personal use only and shall not be submitted to contests or reproduced for commercial use. The Client shall not make, or provide authorization to a third-party to make, reproductions of works resulting from this Contract without express permission of the Photographer. INDEMNIFICATION PHOTOGRAPHER and CLIENT agree that PHOTOGRAPHER is under no obligation to capture any specific moment or pose or person(s) during the SHOOT. If PHOTOGRAPHER is unable to perform the services in this contract due to any cause outside its control, client agrees to indemnify photographer for any loss damage or liability; however, PHOTOGRAPHER will return in full all payments made by CLIENT to PHOTOGRAPHER in relation to this SHOOT. CLIENT agrees to indemnify and hold harmless PHOTOGRAPHER for any liability, damage, or loss related to technological failure, including data loss. CLIENT understands and agrees that PHOTOGRAPHER is not required to maintain copies of the photos from this shoot 60 (sixty) days after the photos have been delivered to CLIENT. CLIENT agrees to hold PHOTOGRAPHER harmless for any personal injury which may occur as the CLIENT poses or works with PHOTOGRAPHER. CLIENT agrees not to use any SOCIAL MEDIA FILTERS on the images provided by the photographer. Using any kind of FILTERS alters photographer's work.
